3. Product, Price, and Payment Information
The basic features of the product, its quantity, the sales price including taxes, and any discounts, if applicable, are shown to the Buyer before the order is completed. The shipping fee, if any, to be applied to the order, the payment method, and the final total amount to be paid by the Buyer are presented to the Buyer before the payment obligation arises.
By confirming the order, the Buyer accepts that the order creates a payment obligation.
Payment is made using one of the payment methods offered on the website during the order.
4. Delivery
Orders are prepared in line with stock and order status after payment confirmation and delivered to the shipping company. Products are shipped to the delivery address specified by the Buyer during the order, within the delivery periods stipulated in the applicable legislation.
Delivery times may vary depending on the delivery address, the shipping company's operations, public holidays, force majeure, and other circumstances beyond the Seller's reasonable control. In these cases, the provisions of the applicable legislation shall apply, and the Buyer's rights arising from the legislation are reserved.
Free shipping conditions and the shipping fee to be borne by the Buyer, if any, are shown to the Buyer before the order is completed and before the payment obligation arises. The final shipping fee seen by the Buyer before the order is completed shall be taken as a basis.
If this option is available during the order, the Buyer may choose to pick up their order free of charge from the showroom location specified by the Seller.
5. Seller's Obligations
The Seller is obliged to deliver the product in accordance with the specifications stated in the order, completely and in accordance with the relevant legislation.
If the delivery of the product subject to the order becomes impossible, the Buyer will be informed, and the collected amounts will be refunded to the Buyer within the periods stipulated in the relevant legislation.
6. Buyer's Obligations
The Buyer agrees that the information provided within the scope of order, payment, invoice, and delivery processes is accurate and complete, and that they are obliged to pay the total amount shown to them before the order is completed.
In case of apparent damage to the outer packaging during delivery, it is recommended that the Buyer requests a damage assessment report from the cargo officer. Failure to prepare a damage assessment report does not eliminate the Buyer's rights arising from the legislation regarding defective goods.
7. Right of Withdrawal
The Buyer may exercise their right of withdrawal without giving any reason and without paying any penalty, within fourteen (14) days from the date they receive the product, subject to the exceptions to the right of withdrawal.
Notification of the exercise of the right of withdrawal must be made to the Seller before the expiration of the withdrawal period. The withdrawal notification can be sent via e-mail to hello@serenithway.com.
Unless the Seller offers to retrieve the product themselves, the Buyer is obliged to send the product back to the Seller within the procedures and periods stipulated in the applicable legislation, after notifying the Seller of their exercise of the right of withdrawal.
8. Refund in case of Withdrawal
The Seller, from the date the withdrawal notification reaches them, within the framework of the conditions stipulated in the legislation, shall refund the payments collected from the Buyer that are required to be refunded in accordance with the relevant legislation, within the period stipulated in the legislation, in a manner appropriate to the payment instrument used by the Buyer during the purchase.
The Seller may withhold the refund until the Buyer provides a document confirming that they have returned the product, or until the product reaches the Seller, in cases where the relevant legislation permits.
The time it takes for banks or payment institutions to reflect the refunded amount to the Buyer's account or card may vary depending on the processing times of the relevant institutions.
9. Exceptions to the Right of Withdrawal
The provisions of the Distance Contracts Regulation and relevant legislation shall apply regarding cases where the right of withdrawal cannot be exercised.
Exceptions to the right of withdrawal do not eliminate the Buyer's rights arising from legislation regarding defective, damaged, missing, or incorrectly delivered products.
10. Defective Product and Dispute Resolution
In the case of defective, damaged, missing, or incorrectly delivered products, the Buyer's rights arising from Law No. 6502 on Consumer Protection and relevant legislation are reserved.
In disputes arising from this Agreement, applications can be made to Consumer Arbitration Committees or authorized and competent courts where the Buyer's residence is located or where the consumer transaction took place, within the framework of current monetary limits and relevant legislative provisions at the date of application.
11. Evidence and Enforcement
Electronic records, order summaries, payment records, and correspondence between the parties can be used as evidence in accordance with the legislation.
This Agreement comes into force with the Buyer's electronic confirmation of the order.
